事件經(jīng)過:2004年6月至2005年6月,本人通過中介找到一套房子,看了還覺得滿意,簽了合同,交了2個月的房租,其中一個月是押金。搬進(jìn)去一周內(nèi),把所有的房間里現(xiàn)有的問題(包括墻面的劃痕,家具的損傷磕碰,衛(wèi)生間的水垢等等)全部照相,找了中介簽字。早就聽說中介也黑,房東也黑,所以說也算是十分小心了,住了一年,基本上是十分小心,只是廚房不可避免的有些油煙,自己也無法清洗,另加上墻面有些劃痕,但絕對是很小的劃痕。
2005年提前2個月通知房東和中介,按時搬出了這套房子。房東的無賴本質(zhì)從這個時候就開始表現(xiàn)了。提前2個月的時候發(fā)email,就說到要退押金的事情,一開始說好,搬家后,一周內(nèi)檢查房屋,如果沒有問題,一周就退押金。結(jié)果我們搬家的時候,房東也沒有出現(xiàn),只是有個中介的人,拿了一張表,記了些東西走了。我們沒有辦法,只有不停的打電話給中介,給房東發(fā)email, 催來催去,終于等到一封中介的信(5個月距離我搬家)。 信中告訴我們說是房東不同意退還押金,說是因為我們走后,他找人重新裝修,包括整理墻面,重新粉刷等等,花了900多英鎊,比押金還要多,所以押金不予退還。 同時附上一份 INVOICE,是裝修公司給房東的,總價976.50英鎊。發(fā)票內(nèi)容如下

乍眼一看,好像沒有什么問題,但是越想越來氣,憑張發(fā)票就976英鎊,靠,搶錢呢,我們搬家的時候仔細(xì)檢查過所有房間,根本就沒有什么大的毛病,唯一的問題是廚房有些油煙無法清洗,其他的都和搬進(jìn)去的時候沒有什么區(qū)別。
好吧,是以至此,兩個選擇。 1,忍了,就當(dāng)976英鎊給房東買藥吃了。 2,繼續(xù)和他們糾纏下去,不管什么結(jié)果,不能讓他們覺得我們這么好欺負(fù)。有時候在想,這些阿差就是因為看準(zhǔn)了中國人的忍讓,對我們得寸進(jìn)尺。
感謝我的一個老外朋友,知道后主動提出來幫我,更重要的是:他是一個律師,他拿走了裝修公司的發(fā)票還有相關(guān)合同,過了幾天幫我寫了一封信,直接寄到了裝修公司的地址(注意哦,是裝修公司的地址,不是房東)。 嘿,1個禮拜以后,我們家收到一封信,信里詳細(xì)的列出了重新粉刷廚房所需要的費用--- 80 英鎊, 另外和信一起的,還有一張支票,是我的押金,扣除了80英鎊,其余的錢全部退還了!!!!!! 。朋友知道了,很多人都說我幸運,很難要回來的錢居然被要了回來。但是回頭來看,其實還是得益于法律制度,只要自己的要求是合法的合理的,就可以去爭取,應(yīng)用法律的手段去保護(hù)自己應(yīng)得的利益。
這里,我想公開這封律師幫我寫的信,希望如果大家有遇到類似情況的,可以參照。這封信是寫給這個裝修(清潔)公司的,一開始,我不理解,為什么要給裝修公司寫信,而不是給房東,但是看完這封信后,我明白了為什么會有效果。

a. Produce all original receipts for the material that you purchased?
b. Produce a detail of the man – hours you allocated for each of the tasks that you carried out?
c. Please confirm the date that you attended the premises?
d. Please explain: - What “rubbish” you cleared?
Describe the wardrobe you cleared?
Describe in detail what “food” you cleared from walls?
Describe what you mean by cleaning all woodwork?
Describe in detail what you mean by “redecorating of flat
throughout”?
e. Please confirm if you are a member of any governing body?
f. Please identify who attended the premises. Please provide full name, address, date of birth?
Please provide a copy of the bank statement showing receipt of cheque for ?976.50. If you claim that the entire amount was received in cash, please confirm?
Please note that in issuing proceedings against the landlord you would be called to provide sworn evidence at court. Providing false evidence may lead to a charge of contempt and is punishable. It is suspected that someone may be using your ID to produce false statements and or that the unsigned letter as enclosed is falsified.
We await your response within the next seven (7) days. Regardless to whether you provide a response or not court proceedings may include you.
